Terms of Service

These Terms of Service ("Terms") govern your access to and use of CommissionIQ (the "Service"), operated by CourtageIQ ("we", "us", "our"). By creating an account or using the Service, you agree to these Terms.

1. The Service

CommissionIQ is a software tool that helps property and casualty insurance brokers track clients, policies, commissions, splits, endorsements, and renewals. The Service is provided as-is to help you organize your own business information.

2. Accounts

You are responsible for maintaining the confidentiality of your login credentials and for all activity under your account. You must provide accurate information and keep it up to date. You must be authorized to act on behalf of any brokerage whose data you enter.

You retain ownership of the business data you enter. You grant us a limited licence to store and process it solely to provide the Service. Our handling of personal information is described in our Privacy Policy.

5. Acceptable use

You agree not to misuse the Service, including by attempting to access other users' data, disrupting the Service, reverse-engineering it, or using it for any unlawful purpose.

6. Accuracy and professional responsibility

CommissionIQ is a tracking and calculation tool. It does not provide financial, legal, regulatory, or insurance advice. You are solely responsible for verifying the accuracy of figures, commission calculations, and any decisions you make using the Service. We are not a party to your relationships with insurers, clients, or partners.

7. Availability

We aim to keep the Service available but do not guarantee uninterrupted access. We may modify, suspend, or discontinue features with reasonable notice where practical.

8. Limitation of liability

To the maximum extent permitted by law, CourtageIQ is not liable for any indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the Service. Our total liability is limited to the amount you paid for the Service in the twelve months preceding the claim.

9. Termination

You may stop using the Service at any time. We may suspend or terminate accounts that violate these Terms. Upon termination, your right to use the Service ends.

10. Governing law

These Terms are governed by the laws of the Province of Quebec and the applicable laws of Canada. Any dispute will be subject to the jurisdiction of the courts of Quebec.
